End user licence agreement
The terms we intend to license CEIWEI CommMonitor under.
This is a draft, published so that you can read the terms before you buy. It has not yet been reviewed by a lawyer and it is not a signed agreement; the version delivered with a purchased licence will prevail.
This document is published in English. If a translation appears elsewhere, the English version prevails.

1. Licence grant
CEIWEI Software Technology grants you a non-exclusive, non-transferable licence to install and use CEIWEI CommMonitor on the number of machines covered by your order.
- A single-machine licence may be activated on one machine at a time.
- A volume or site licence covers the number of machines stated in the order.
- A trial edition is issued as a time-limited key with a row-capped export; its limits are described on the pricing page.
2. Activation and hardware binding
Licences are verified locally on your machine. The application carries a public key and checks the signature of the licence file you import; it does not need to contact us to run.
- If you choose online activation, the application sends the licence key and the machine fingerprint to the activation endpoint you have configured.
- A licence is bound to hardware identifiers collected in a fixed order: motherboard UUID, system disk serial, physical MAC address and the Windows machine GUID.
- If you replace hardware, we re-issue the licence on request. Do not send licence keys by email; send the fingerprint instead.
3. The bundled kernel driver
Capture requires a kernel-mode filter driver that is installed by the application with administrator rights. By installing the product you accept that a kernel component is present on the machine.
- The driver is installed install-only; there is no uninstall action, because stopping a filter that sits in a live device stack can leave the device in an undefined state.
- The driver is not a sandbox and does not make third-party software safe.
- Install and evaluate the product on a machine you are prepared to reimage.
4. Restrictions
You may not redistribute the application or the driver, sell or sublicense access to them, or remove copyright and licence notices. You may not reverse engineer the product except to the extent that applicable law expressly permits it.
5. Third-party components
The product includes or links against third-party and operating-system components. Their notices are summarised on the third-party components page, and a current inventory is available on request.
6. No warranty
The product is provided as is. We do not warrant that it is free of defects, that capture will be uninterrupted, or that it is fit for a particular purpose. You are responsible for deciding whether the product is suitable for your environment and for complying with the rules that apply to it.
7. Limitation of liability
To the extent permitted by applicable law, our total liability under this agreement is limited to the amount you paid for the licence in the twelve months before the claim. We are not liable for indirect or consequential loss, including lost data or lost production.
8. Termination
The licence ends if you materially breach these terms. On termination you must stop using the product and remove it from your machines, except where the driver cannot be removed without leaving a device unusable - in that case, disabling monitoring is sufficient until the machine is reimaged.
9. Governing law
The governing law and venue for this agreement are being settled with counsel and will be stated in the version delivered with a purchased licence. Until then, this section is deliberately left open rather than guessed.
